Ontario Municipal Board - Rules of Practice and Procedure, amended 3 September 2013

On September 3, 2013, the Ontario Municipal Board amended its Rules of Practice and Procedure.  The recent changes include an amendment to Rule 21, Prefiling of Witness Statements and Reports, and the introduction of new Rule 21.01, Duty of the Expert Witness.  Rule 21 requires the expert witness statement to include an executed acknowledgement of expert’s duty form, and new Rule 21.01 parallels Rule 4.1.01 of the Rules of Civil Procedure made under the Courts of Justice Act relating to the duty of an expert witness.
