Bill 108: Planning Act Changes

May 07, 2019

On 2 May 2019, Bill 108, More Homes, More Choice Act, 2019 received its first reading by the Ontario Legislature. Bill 108 proposes amendments to a number of statutes related to development. See our blog post here for a list of Acts affected by Bill 108.

In particular, Bill 108 proposes to repeal many of the amendments made to the Planning Act in 2018 through Bill 139, including the appeal provisions related to official plan and zoning by-law amendments and reducing municipal processing timelines.  Section 37 is repealed and replaced with a new concept, community benefit charges, while Section 42 parkland dedication requirements are also amended.

A table comparing the sections of the current Planning Act against the changes proposed by Bill 108 is found here.
